Take an AGRO loan or a BUSINESS Credit and receive back 10% of the contracted non-bank loan issuance fee and 3% of the amount of interest and administration fee paid by the client in accordance with the concluded non-bank loan agreement. REGULATIONS OF THE "CASHBACK" PROMOTIONAL CAMPAIGN organized by OCN "Mikro Kapital Company" SRL
GENERAL DISPOSITIONS
1. Name of the promotional campaign: "Cashback" (hereinafter referred to as "Promotion").
2. The organizer of the promotional campaign: OCN "Mikro Kapital Company" SRL, IDNO/fiscal code: 1013600010536, with headquarters: on Alexandr Pușkin str., 45/B, et. 1, Chisinau municipality, Republic of Moldova, MD-2012, Chisinau municipality, Republic of Moldova. www.mikrokapital.md; goal. + 373 22 628822 (hereinafter referred to as "Organizer").
3. Promotion period: 01.09.2020-31.12.2020.
4. Cashback - (from the English language "money back") - for the purposes of this Promotion, represents a monetary value calculated in accordance with these Regulations, for the benefit of the customer, as partial compensation for the expenses incurred by him in accordance with the non-bank credit agreement concluded, which the latter can use/value exclusively within the credit transactions established with the Organizer, without being able to withdraw this amount in cash or by bank transfer.
5. The promotional campaign is carried out exclusively according to the rules of this regulation (hereinafter referred to as "Regulation"). Thus, the rules set out in the Regulations are mandatory for all participants in the Promotional Campaign, and the participation of eligible persons in the Campaign constitutes proof of full knowledge and acceptance, without objections, definitively, of the conditions and rules set out in these Regulations.
6. This Regulation is drawn up in accordance with the provisions of the Civil Code and the Fiscal Code of the Republic of Moldova.
CONDITIONS OF PARTICIPATION
7. Individuals with full legal capacity can participate in the Campaign, as well as legal entities from the Republic of Moldova who meet the eligibility criteria according to the Organizer's Credit Regulation (hereinafter referred to as "clients"), who, knowing the provisions of this Regulation, during the promotion period wish to participate in the Campaign by concluding a non-bank credit contract with the Organizer at one of its Branches.
8. Participants in the promotion cannot be employees of the organizer and members of his family.
9. Participation in the Campaign implies acceptance of the provisions of this Regulation.
CAMPAIGN MECHANISM, CASHBACK PROCEDURE AND CONDITIONS
10. The credit products of the Organizer participating in the Cashback Promotional Campaign are the following: Rapid Loan, Agro and Business.
11. The cashback will be granted to the participant who will fulfill the granting conditions and consists of 2 parts in the amount of: 10% of the commission for issuing the contracted non-bank credit and 3% of the sum of the interest and the administration commission paid by the customer according the contracted non-bank credit contract.
12. The accumulated cashback can be used by customers only after the expiration of a period of 6 months from the date of issuance of the credit participating in the promotion and is valid for 12 months from the date of full payment of the credit for which it was granted.
13. The amount of accumulated Cashback can be used by customers to pay:
a) the last payment on the credit for which it was calculated, resulting from the available limit;
b) up to 50% of the amount of the release commission for credits granted after the one for which the Cashback was calculated, based on the available limit;
c) the last payments on loans contracted after the one for which the Cashback was calculated, resulting from the available limit.
14. If the customer uses the cashback amount in subsequent credits, he will receive a bonus of +20% of the accumulated and unused Cashback amount.
15. The amount of accumulated cashback, including the bonus provided for in point 14 of the Regulation, will not exceed the ceiling of 24,000 MDL.
16. Cashback will not be granted in the following cases:
a) to the renegotiation, extension or other requests through which the client will request the modification of the initial conditions established in the credit agreement;
b) acceptance by the client of delays of more than 30 days in paying the monthly installments established in the loan repayment schedule;
17. If the customer admits at least one of the cases listed in point 16, he will not benefit from cashback and the cashback amount
PROTECTION OF PERSONAL DATA
18. All participants in the Promotion are guaranteed their rights in accordance with the Law of the Republic of Moldova "Regarding the protection of personal data" no. 133 of July 8, 2011.
19. By participating in the Promotional Campaign, participants give free, express and unconditional consent to the processing of their personal data by the Organizer.
TAXES AND FEES
20. Participation in the Campaign does not involve any additional costs from the customers.
21. In accordance with the provisions of the Fiscal Code, from the winnings from promotional campaigns in the part where the value of each winning exceeds the size of the personal exemption established in art. 33 paragraph (1), the Organizer undertakes to withhold, declare and pay, in the term stipulated by the tax legislation, the amount of tax withheld.
DISPUTES.
22. In the event of potential disputes arising between the Organizer and the participants in the Promotional Campaign, they will be resolved amicably. If it is not possible to resolve the disputes amicably, the parties involved in the dispute will apply for resolution to the competent courts of the Republic of Moldova in whose jurisdiction the Organizer is located.
23. Any complaints related to the running of the Promotional Campaign can be sent to the Organizer's address within the term of the promotional campaign. After the expiration of the promotion period, the Organizer will no longer consider complaints related to the running of the Promotional Campaign.
FINAL PROVISIONS
24. The campaign may end before the deadline or be suspended, both in case of an impediment beyond the Organizer's control, as regulated by the legislation in force, including in the case of impossibility invoked by the Organizer. Early termination or suspension will be communicated by publishing a notice on the official web page www.mikrokapital.md. The organizer reserves the right to grant cashback capitalized in the period up to the date of suspension or termination.
25. The organizer reserves the right to unilaterally change these Regulations and the conditions of the Promotional Campaign, these changes being made known to the public by posting them on the official web page www.mikrokapital.md in reasonable terms. The changes will enter into force on the date of publication on the web page or on the date expressly indicated in the act of change.
26. By participating in the Campaign, participants confirm their agreement to comply with the rules and conditions established by these Regulations. If the Organizer finds that a winner has not fulfilled and/or has not complied with the conditions of these Regulations, the Organizer reserves the right to suspend the rights and benefits of the cashback beneficiary at any time, without further compensation or payments.
